Forty-seven people were sentenced to death in
Japan in 2007, marking the highest figure on Supreme Court
records going back to 1980, a Mainichi survey has shown.
A total of 107 people are on death row , the highest
year-end figure in the postwar era, the survey also found.
A tendency to toughen sentences out of consideration for
the feelings of crime victims is thought to be behind the
high number of death penalty rulings.
From 1980, the number of people sentenced to death each
year ranged between five and 23, but in 2001 the figure
climbed to 30. In 2004, the number reached 42, and after
declining to 38 in 2005, it hit 44 in 2006.
Death sentences for 23 people were set this year. Five of
these dropped their appeals, and 18 had their appeals
thrown out by the Supreme Court. The death penalty was
inflicted on nine people this year, the survey found.
死刑判決：０７年は４７人…８０年以降最多 厳罰化傾向
全国の裁判所で今年死刑を言い渡された被告が４７人に上り、最高裁にデータがある８０年以降最多だったことが毎日新聞の調べで分かった。拘置所に収容されている死刑確定者も１０７人に上り、年末としては戦後最多となった。被害者感情を重視し、厳罰化傾向が進んでいることが背景にあるとみられる。
４７人の内訳は▽１審で１５人▽２審で１４人▽上告審の最高裁で１８人。死刑判決を受けた被告数は８０年以降、年間５～２３人だったが、０１年に３０人に達してからは▽０２年２４人▽０３年３０人▽０４年４２人▽０５年３８人▽０６年４４人－－と増え続けている。
主な死刑判決は▽仮釈放中に再び殺人事件を起こした西山省三死刑囚（５４）＝４月１０日、最高裁▽地下鉄サリン事件の散布役では初めて死刑が確定した元オウム真理教幹部、横山真人死刑囚（４４）＝７月２０日、同▽前橋スナック乱射事件の矢野治被告（５９）＝１２月１０日、東京地裁－－など。
今年死刑が確定したのは、自ら控訴を取り下げた５人と、最高裁が上告を棄却した１８人の計２３人。今年は９人に死刑が執行されたが、年末の収容数は昨年の９４人から更に増えた。【高倉友彰】
▽渥美東洋・京都産業大法科大学院教授（刑事法）の話 メディアの犯罪報道などによって社会に厳罰主義の流れが進み、司法判断も影響を受けていることが、死刑判決増加の背景にある。刑法犯の認知件数は減ってきているのに、全く落ち度がない子供が被害者になるような残忍な犯罪が増えていることも理由の一つだ。幼少期のうちから、集団の構成員となるために必要な価値や規範を身に着けられるような福祉的活動や行政サービスを充実させ、死刑に相当する残忍な事件を減らしていく社会全体の努力が必要になっている。
